Landlord drags tenant's father to court over rentals PDF Print E-mail

AN enraged Mutare man dragged the father of his tenant to court after the son had failed to pay rent and utility bills.


Takesure Musanidza brought his tenant's father to court claiming $150 which he said was accrued by Blessing Masademba's son during his stay at his house.
The two appeared before Mutare magistrate, Mrs Patience Madondo, with Musanidza demanding $150 from Masademba as arrears for the utility bills his son allegedly failed to pay during his stay at his home.
"Your worship, the respondent's son was a tenant at my house since January to June.  He failed to settle electricity, water and rental bills as well as the reconnection fee as initially agreed upon which is amounting to $150," said Musanidza.

The court heard that the two had agreed that Musademba's son would pay an amount of $40 each month, but he never paid anything.
Musanidza further alleged that Musademba's son broke one of the windowpanes at the house.
However, Musademba disputed the claims and said he was not in a position to pay anything, but rather Musanidza should pay him $150 on the basis that he used his son to harvest crops from his fields without his consent.
"The plaintiff abused my son by forcing him to harvest the crops in his fields.  He took away his mattress and gave it to his son who is enrolled at a local boarding school during the first school term, leaving him without anything to sleep on. 
“The plaintiff together with his family used the son's two-hot plate stove without my consent," said Musademba.
The matter was however adjourned to a later date.
